1. Scope
These Terms and Conditions apply to all orders placed by consumers and businesses through our online shop.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. A business is any natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade or profession.
For businesses: If the business uses conflicting or supplementary terms and conditions, their validity is hereby objected to; they shall only become part of the contract if we have expressly agreed to them.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with Bidabadi GmbH.
By placing the products in the online shop, we make a binding offer to enter into a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded by clicking the order button to accept the offer for the goods contained in the shopping cart. Immediately after submitting the order, you will receive another confirmation by email.
3. Contract Language, Storage of the Contract Text
The language(s) available for concluding the contract: German, English.
We store the contract text and send you the order data and our Terms & Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery Conditions
4.1 Delivery Area
We deliver within Germany.
4.2 Shipping Costs
Standard delivery is free of charge.
4.3 Delivery Options
We ship the products to the delivery address specified during the ordering process.
We deliver by shipping only. Self-collection of the goods is unfortunately not possible.
We do not deliver to Packstations.
5. Payment
5.1 Prices
The prices valid at the time of the order apply. These are total prices and include statutory VAT.
5.2 Due Date and Default
The price is due upon conclusion of the contract, unless a later date results from the following payment terms.
For consumers: In the event of payment default, we reserve the right to charge a fee of EUR 1.50 for the second and each subsequent reminder. You may provide evidence that less damage has occurred. Further claims remain unaffected.
For businesses: In the event of payment default, we reserve the right to charge statutory default interest at nine percentage points above the base interest rate as well as a flat fee of EUR 40. Further claims remain unaffected.
5.3 Payment Methods
The following payment methods are generally available in our shop.
Bank Transfer (Advance Payment)
When selecting advance payment, we will provide our bank details in a separate email and deliver the goods after receipt of payment.
Credit Card
During the ordering process, you enter your credit card details. Your card will be charged immediately after placing the order.
SEPA Direct Debit
By placing the order, you grant us a SEPA direct debit mandate. We will inform you of the date of the account debit at least one banking day in advance (prenotification). A banking day is any business day except Saturdays, nationwide public holidays in Germany, and December 24 and 31. The account debit takes place before the goods are dispatched.
Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have Apple Pay enabled, authenticate with your login details and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.
giropay
In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M., we offer the payment method giropay. To pay the invoice amount via giropay, you must have a bank account enabled for online banking, authenticate accordingly and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information is provided during the ordering process.
giropay may offer additional payment options to registered giropay customers selected according to its own criteria. We have no influence over the offering of these options; any additionally offered payment options concern your legal relationship with giropay. Further information can be found in your giropay account.
Google Pay
To pay the invoice amount via Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay enabled, authenticate with your login details and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.
Klarna
In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options. Payment via Klarna is available to consumers only. Unless stated otherwise below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is provided with the respective payment option and during the ordering process.
Klarna Credit Card
During the ordering process, you enter your credit card details. Your card will be charged by Klarna immediately after placing the order. No address or credit check takes place.
PayPal
To pay the invoice amount via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate with your login details and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. Further information is provided during the ordering process.
PayPal may offer additional payment modalities in the customer account to registered PayPal customers selected according to its own criteria. We have no influence over the offering of these options; any additionally offered payment modalities concern your legal relationship with PayPal. Credit Card via PayPal
Your card will be charged by PayPal after dispatch of the goods.
Direct Debit via PayPal
Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. PayPal will inform you of the date of the account debit (prenotification). The account debit takes place before the goods are dispatched.
Purchase on Account via PayPal
Purchase on account via PayPal requires an address and credit check and is made directly to PayPal.
Sofort by Klarna
To pay the invoice amount via Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, authenticate accordingly and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information is provided during the ordering process.
6. Right of Withdrawal
Consumers have the statutory right of withdrawal as described in the cancellation policy. No voluntary right of withdrawal is granted to businesses.
7. Retention of Title
The product remains our property until paid for in full.
For businesses, the following applies in addition: We retain title to the product until full settlement of all claims arising from an ongoing business relationship. You may resell the reserved goods in the ordinary course of business; you hereby assign to us in advance all claims arising from such resale in the amount of the invoice value, irrespective of any combination or mixing of the reserved goods with a new item, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves to the extent that you do not meet your payment obligations. We will release the securities to which we are entitled at your request insofar as the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.
8. Transport Damage
For businesses: The risk of accidental loss and accidental deterioration passes to you as soon as we have handed over the item to the carrier, freight forwarder or other person or institution designated to carry out the shipment.
9. Warranty and Guarantees
9.1 Statutory Liability for Defects
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following limitations and shortened periods do not apply to claims for damages caused by us, our legal representatives or agents
- in the event of injury to life, limb or health,
- in case of intentional or grossly negligent breach of duty and fraud,
- in the event of a breach of essential contractual obligations (cardinal obligations), the fulfillment of which is essential for the proper performance of the contract and on the observance of which the contractual partner regularly relies,
- within the scope of a guarantee, if agreed, or
- where the scope of application of the Product Liability Act is opened.
Restrictions vis-à-vis businesses
With respect to businesses, only our own specifications and the manufacturer's product descriptions included in the contract are deemed to constitute an agreement on the quality of the goods; we assume no liability for public statements by the manufacturer or other advertising statements. For businesses, the limitation period for defect claims for newly manufactured items is one year from the transfer of risk. The previous sentence does not apply to an item that has been used for a building in accordance with its usual use and has caused its defectiveness.
The statutory limitation periods for recourse claims pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.
Notice for merchants
Among merchants, the duty of inspection and notification regulated in Section 377 of the German Commercial Code (HGB) applies. If you fail to make the notification specified there, the goods shall be deemed approved, unless it is a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.

We are always liable without limitation for claims for damages caused by us, our legal representatives or agents
- in the event of injury to life, limb or health,
- in case of intentional or grossly negligent breach of duty,
- in the case of guarantees, if agreed, or
- where the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on the observance of which the contractual partner regularly relies (cardinal obligations), due to slight negligence on our part, our legal representatives or agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract and typical for such contracts. Otherwise, claims for damages are excluded.

To settle disputes arising from a contractual relationship with a consumer or as to whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer conciliation body. The competent body is the Federal Universal Conciliation Body at the Center for Conciliation e.V., Straßburger Straße 8, 77694 Kehl am Rhein, Germany, https://www.universalschlichtungsstelle.de/. We will participate in dispute resolution proceedings before this body.
